Disability Attorney in Fargo
Disability Law Since 1991. No Fees Until You Win Benefits.
When a medical condition prevents you from working, federal disability benefits through Social Security Disability Insurance (SSDI) or Supplemental Security Income (SSI) can be the financial foundation you need. The claims process involves strict SSA eligibility rules, documentation requirements, and deadlines that trip up even well-prepared applicants. Ficek Law has focused on disability law and Social Security disability claims since 1991, and every case we take moves through a firm built entirely around this area of law.
We serve Fargo residents and clients throughout North Dakota, South Dakota, Minnesota, and Montana. Free consultations are available, and we charge no hourly or retainer fees at any stage of representation.

Disability Claims We Handle
Claimants arrive at different points in the process and with different types of claims. We represent clients at every stage.
SSDI & SSI Claims
SSDI is based on your work history and Social Security contributions. SSI is based on financial need and doesn’t require a work record. Both programs follow the SSA’s definition of disability, but the eligibility rules and benefit amounts differ. We help clients determine which program applies to their situation and build the strongest possible application from the start.
Private Disability Insurance Claims
Employer-sponsored and individual disability insurance policies use their own definitions of disability and operate outside the SSA system entirely. We assist clients whose private disability insurance claims have been delayed, underpaid, or denied.
Denied Claims & Social Security Appeals
Most initial applications are denied, even for serious conditions. A denial isn’t the end. We represent clients through every appeal stage, from reconsideration through administrative law judge (ALJ) hearings, working to pursue the benefits they may be entitled to. We’ve represented hundreds of clients across all types of disability claims.
Why Fargo Claimants Work With Ficek Law
Tony Ficek founded this firm to do one thing: disability law. That focus, sustained for more than 30 years, means our knowledge runs deep. We aren’t dividing attention across personal injury, family law, or criminal defense. Every process we’ve built, every precedent we’ve tracked, and every relationship we’ve developed serves disability claimants.
Tony is licensed to practice in North Dakota, South Dakota, Minnesota, and Montana. Ficek Law holds memberships with NTL and NOSSCR and carries a Better Business Bureau rating. Clients consistently note responsive communication, clear step-by-step guidance, and a willingness to take on difficult cases, including prior denials and conditions that aren’t immediately obvious in medical records.
Our fee structure removes the financial barrier at the moment claimants can least afford one. No retainer. No hourly billing. We work on contingency, which means attorney fees apply only when we help you secure benefits or settle your claim.

How Do I Communicate My Functional Limitations? In your Initial Application, you told SSA why you cannot work. This might be your physical health (back, hands, arms, legs) or your mental health (difficulty with people) or both. Each time you go to the doctor, you should tell your doctor every symptom you are experiencing that is preventing you from working. Always remember, if a medical issue is preventing you from working, but it is not consistently reflected in your medical records, to SSA, it is as if it doesn’t exist.

What Are My Chances for Approval at the Reconsideration Appeal?Low. About 90% of Reconsideration appeals are denied. Reconsideration Appeals are typically a “rubber stamp” of the Initial Application. Denials are a very normal part of SSA’s process and not something to take personally. SSA is a large, inefficient government system that forces the majority of claimants to file two appeals prior to any chance at approval.
