Social Security Adjustments

North Dakota Social Security Adjustment Attorney

Navigating SSDI Adjustments in South Dakota & Minnesota

The Social Security Administration (SSA) annually revises benefit amounts, income limits, and work thresholds to reflect inflation and broader economic shifts. While a yearly cost-of-living adjustment (COLA) typically increases your monthly payment to help you afford rising prices, the simultaneous rise in earning limits can create confusion.

Interpreting the new figures correctly is essential if you are attempting to work while receiving benefits. At Ficek Law, we can help you make sense of these shifting regulations and explain how they affect you in simple, clear terms. Our team can review your specific circumstances against the forthcoming year's thresholds to help prevent errors that could lead to overpayment notices, allowing you to make confident decisions about your work and income without jeopardizing your support.

Our experienced attorney exclusively focuses on Social Security disability law and takes a compassionate, hands-on approach to each case. We aim to make our legal services accessible, which is why we take cases on contingency and don’t charge hourly rates or retainer fees.

What Is the Cost-of-Living Adjustment (COLA) for Social Security Disability Benefits in 2026?

For 2026, the Social Security Administration increased disability benefits by 2.8%. This COLA officially takes effect in January 2026 to help beneficiaries keep pace with inflation and the rising price of consumer goods.

This benefit increase will occur automatically. In most cases, you will not need to take any additional action for this COLA to apply to your checks.

  • How Do I Communicate My Functional Limitations?
In your Initial Application, you told SSA why you cannot work. This might be your physical health (back, hands, arms, legs) or your mental health (difficulty with people) or both. Each time you go to the doctor, you should tell your doctor every symptom you are experiencing that is preventing you from working. Always remember, if a medical issue is preventing you from working, but it is not consistently reflected in your medical records, to SSA, it is as if it doesn’t exist.
  • What Are My Chances for Approval at the Reconsideration Appeal?
Low. About 90% of Reconsideration appeals are denied. Reconsideration Appeals are typically a “rubber stamp” of the Initial Application. Denials are a very normal part of SSA’s process and not something to take personally. SSA is a large, inefficient government system that forces the majority of claimants to file two appeals prior to any chance at approval.
